This Privacy Policy was prepared by MB Oyun Yazılım ve Pazarlama A.Ş. (“Madbyte Games”) with its headquarters at Reşitpaşa Mah. Katar Cad. Arı 2 Binası No: A Blok/4/1 İçkapı501, 34467 Sarıyer / İstanbul as the data controller in order to inform you about the methods of collection, processing, use, transfer and destruction of your personal data under Article 10 “Data Controller’s Disclosure Obligation” and Article 11 “Rights of the Data Owner” of the Personal Data Protection Law 6698 (“PDPL”).

Madbyte Games shall process your personal data within the scope of the personal data processing conditions and purposes specified by the PDPL and

  • in accordance with the law and the rules of honesty,
  • by preserving the accuracy and most up-to-date version of the personal data you share,
  • for specific, explicit and lawful purposes,
  • in connection with the purpose for which they are to be processed, in a limited and measured manner,
  • according to the conditions and purposes stipulated in the relevant legislation or as required by the purpose for which they are processed.

Collection of Personal Data, Processed Personal Data and Purpose

Your personal data are collected directly from you during your visit to madbytegames.com and when you contact customer service. In addition, device and usage data are collected via third-party SDKs integrated into our games.

Processed Personal Data and Purpose. Madbyte Games processes:

  • your username, email address and phone number
    • to create a user database,
    • to retrieve the account when the password is forgotten,
    • to ensure that the service is used to carry out customer service operations,
  • your device features and usage data in order to optimize our games, resolve technical issues and ensure the highest user experience,
  • your IP address to provide information to the prosecutor and judicial authorities in cases of fraud, including theft of your user account,
  • crash logs and diagnostics to maintain system stability and security.

Information for Mobile Applications

No personal data is transferred to Madbyte Games when you download mobile games published by Madbyte, while using mobile games or make in-game purchases in mobile games. All purchases or downloads and usage transactions are completed through the Apple App Store and Google Play app stores.

Even in the presence of your explicit consent for personalized advertisements, Madbyte Games and its suppliers process your in-app activity and advertisement interactions anonymously.

Legal Grounds for Data Processing

Data processing is necessary to benefit from and purchase Madbyte Games products, and to provide customer service and support:

  • for legal purposes under sub-paragraph (a) of PDPL,
  • if directly related to the establishment or performance of the contract under sub-paragraph (c),
  • if mandatory for Madbyte Games to fulfill its legal obligations under sub-paragraph (ç),
  • if necessary to establish, protect and exercise a right of Madbyte Games pursuant to sub-paragraph (e).

The processing of these data is not subject to your consent. In this respect, we inform you that you do not have the right to request the deletion or destruction of your personal data until the end of the retention periods required by the service you use or the law.

Processing Based on Your Explicit Consent

madbytegames.com membership. During your membership, you may be offered the option to share your profile photo, name and surname, educational status, date of birth, occupation, TR ID number, city of residence, country, GSM operator, telephone number and your address with us. However, it is entirely at your choice whether to share this information. Not sharing this information will not prevent you from playing or purchasing Madbyte Games.

The purpose of requesting this information is to create user records and to control disputes related to payments and to manage customer relations.

If, during your membership, you declare your personal data specified here and check the consent box, you will give Madbyte Games your explicit consent to process this data for the specified purposes.

Marketing and advertising purposes. Your name, surname, e-mail address and mobile phone number requested during your membership may also be processed for the purpose of communicating with you if you have given your explicit consent. This may include providing information about new games and promotions.

You can withdraw your explicit consent at any time. Withdrawal will not affect the legality of previous processing based on consent.

Automatic decision-making systems may also be used with data you have made public on social media channels (e.g. Facebook, Instagram).

Transfer of Personal Data to Third Parties

Madbyte Games may transfer your personal data, without the need for your consent,

  • to internal technical and customer support units,
  • to third parties such as banks, audit firms, law firms, attorneys’ offices, financial advisors and suppliers, limited to and proportionate to the service received,
  • to police units, judicial authorities, relevant ministries and other public institutions authorized by law.

Transfers within Turkey are limited to cases where it is mandatory by law, directly related to the contract, necessary for legal obligations, or for the establishment/protection of a right (PDPL Art. 8/2).

Access to Personal Data from Abroad

Madbyte Games stores personal data on servers in Turkey. In certain cases, data such as your email address and device information may be accessed from abroad in order to solve and manage systemic problems. Such access is based on your explicit consent under Article 9/1 of PDPL.

Protection, Retention Period and Destruction of Personal Data

Madbyte Games takes all physical, technical and administrative measures to ensure an adequate level of security and to prevent unlawful processing or access.

  • Personal data are stored for ten (10) years from the last active date of your user account.
  • Data processed for purchases are stored for ten (10) years from the last purchase date.
  • Personal data processed for marketing purposes are stored for two (2) years after your last activity on com.

At the end of these periods, your personal data will be deleted, destroyed or anonymized during the first disposal period.

Madbyte Games also prepares specific clarification texts for users, employees, candidates, suppliers and managers, which are provided separately.

Your Rights

As the data subject, you have the right to:

  • learn whether your personal data are processed,
  • request information on how they are processed,
  • learn the purpose of processing and whether they are used accordingly,
  • know the third parties to whom they are transferred,
  • request correction, deletion or destruction under conditions,
  • request notification of such actions to third parties,
  • object to results obtained through data analysis,
  • request restriction of processing,
  • claim compensation in case of unlawful processing.
